Terms of Service

These Terms apply exclusively to business customers (B2B). Our services are directed at professional Matterport Service Providers and other commercial entities. If you are a consumer (B2C), please contact us at info@16knative.com before ordering, as different terms may apply.

These Terms of Service govern the purchase and use of the panorama processing service (“Service”) provided by Dimension3 GmbH, Werner-Haas-Str. 2, 86153 Augsburg, Germany (“Provider”), operating under the brand name 16K Native at 16knative.com.

By completing a purchase, you confirm that you have read, understood, and agreed to these Terms.

1. Scope of Service

The Service consists of generating high-resolution panorama image sets derived from customer-provided Matterport project data. The Service is a customized data processing service and does not constitute a software product, license, or subscription. All deliverables are provided as downloadable image files as described on the respective order page.

For each project processed, the Provider purchases licensed source data through authorized channels as a prerequisite for processing. This purchase is reflected in the cost structure of the Service.

2. Customer Responsibilities

By placing an order, the customer confirms that:

The Provider does not verify ownership or usage rights of the submitted project. Responsibility for the legality of the submitted data rests entirely with the customer.

3. Project Compatibility

Not all projects are technically compatible with the Service. The Provider reserves the right to decline or cancel processing if a project contains unsupported capture devices or technical limitations that prevent proper processing.

Supported capture devices include the Matterport Pro2, Pro3, and Leica BLK360. Compatibility is verified before processing begins. In cases of incompatibility, the customer will be informed before processing starts and no charge will be applied.

4. Scan Selection

The customer may specify which scan points from a project are included in processing. Only the selected scans count toward the purchased pricing tier. If no scan selection is provided, all scans contained in the transferred project duplicate will be processed up to the purchased scan limit.

5. Processing and Delivery

Processing begins only after the project duplicate has been successfully transferred and technical compatibility has been verified. Standard delivery is 48 to 72 hours from the start of processing.

Delivery timelines depend on project size, selected resolution, and current workload. Any stated turnaround times are estimates and non-binding. In the event of technical issues, unusually high demand, or force majeure events, processing times may be extended. The customer will be informed promptly in such cases. Extended processing times do not constitute grounds for cancellation or refund once processing has begun.

6. Pricing and Payment

All prices are stated in US Dollars (USD) and are exclusive of applicable taxes. VAT is calculated and applied at checkout based on the customer's location and VAT registration status. B2B customers within the EU with a valid VAT identification number may be eligible for VAT reverse charge treatment.

Payment is processed securely via Stripe, Inc. A VAT-compliant invoice is issued for every order.

7. No Right of Withdrawal — Refund Policy

Due to the nature of the Service as a customized digital processing service, there is no right of withdrawal once processing has begun. Refunds are excluded after the start of processing.

If processing has not yet started, the Provider may, at its sole discretion, agree to a cancellation. To request a pre-processing cancellation, contact info@16knative.com immediately after placing your order.

If the Provider determines that a project is technically incompatible after payment has been received but before processing begins, a full refund will be issued.

8. Data Handling

Project data is used exclusively for generating the ordered deliverables. The project duplicate is permanently deleted from our systems immediately after delivery of the ordered files. Further information is provided in our Privacy Policy.

9. Limitation of Liability

The Provider is not liable for:

The Provider does not guarantee that the delivered results are suitable for any specific third-party platform, software, or workflow beyond the general compatibility described in the service description. Liability for intent and gross negligence remains unaffected.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr

We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board and do not generally do so. For B2B disputes, the exclusive place of jurisdiction is Augsburg, Germany.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction for all disputes is Augsburg, Germany.

12. Changes to These Terms

The Provider reserves the right to update these Terms when necessary to reflect legal, technical, or operational changes. The current version will always be available at 16knative.com/terms-of-service.html . Continued use of the Service after changes constitutes acceptance of the updated Terms.
